 | James M. Doran will discuss the process of obtaining and collecting on a judgment in Ohio from start to finish. Topics will include pre-lawsuit considerations, the process of obtaining a judgment and the various collection tools available to collect on the judgment. Collection topics include but are not limited to wage garnishments, bank attachments, creditor’s bills, judgment liens, judgment debtor examinations, third party discovery and more. Scott D. Fink will examine best practices for protection of both secured and unsecured creditor’s interests in Chapter 7 liquidation and Chapter 13 Reorganization proceedings. Topics will include: Reaffirmation of debts, defense of redemption motions, non-dischargeable claims, proofs of claim, relief from the automatic stay, review of chapter 13 plans and objections, cram downs and lien strip actions. Robert Young and Emily Honsa Hicks will discuss the nuts and bolts of foreclosure law in Ohio, with an emphasis on procedures, pitfalls, and best practices. Their discussion will also cover developing issues for creditors such as affidavits, loss mitigation, and post-judgment options.

 | This program will cover three broad topics: (1) An exploration of the ethical rules, both the Ohio Code of Professional Responsibility and the ABA Model Rules, on what constitutes the unauthorized practice of law and the issues to consider when an Ohio attorney acts in a legal capacity in another state; (2) What exactly is professionalism? What are the relevant considerations and limits? Does a prospective client want a lawyer who is professional or can the client even detect the difference; is the client more interested in an effective lawyer as opposed to a professional one?; (3) The who, how and why of the impaired lawyer: the causes, treatment and prevention of impairment are well documented and will be discussed. What about the detection of impairment, though? How can you be sure and how sure do you need to be?

 | Judge Palos will give an update on Ohio Child Support cases and statutes. Judge Palos and Ms. Wirtz will provide an update on State and Local Rules changes which impact family law practice. The attendees will leave with a good understanding of what is expected of them in the Cuyahoga County Domestic Relations Court as to form and substance, as well as upcoming State Rule changes that impact their family law cases. Judge Palos and Ms. Wirtz will also give an overview of Alternative Dispute Resolution processes utilized in Family law cases. They will review the basics of interest based negotiation and how mediation, collaboration, cooperative, facilitation, and arbitration are being used locally and nationally to help divorcing families.

 | | Richard C. Haber and Stephen C. Sutton will discuss current trends in employment law from both the plaintiff and defense perspective. Discussion will involve recent decisions from the Ohio Supreme Court which impacted the Public Policy exception to at-will employment, and decisions from the Ohio Court of Appeals which have interpreted the implications of Ohio’s Tort Reform legislation on employment litigation under Ohio’s Anti-Discrimination Statute. The program will further include a review of decisions from the United State Supreme Court which have impacted arbitration rights, class action practice, and methods of imposing liability upon employers through the “cats paw” theory. This program will also detail recent implementing regulations for the Americans with Disabilities Amendments Act (ADAAA) and will cover other administrative and legislative actions that affect employment law practice. Finally, Mr. Haber and Mr. Sutton will conduct a workshop on case assessment and intake from both the plaintiff and the defense perspective to assist attendees in assessing which cases are worth taking and defending.

 | This seminar will bring a fresh perspective to every trial lawyer preparing their voir dire in a criminal or civil case. With a jury empanelled and presided over by a real judge, four veteran trial lawyers will conduct an actual voir dire presentation. The lawyers will address: burden of proof in criminal cases — getting the jury to understand what “beyond a reasonable doubt” really means; deconstructing the preconceived notions and anti-plaintiff bias that many prospective jurors carry into the courtroom; indoctrinating the jury to large verdicts in employment cases; and preparing jurors for uncorroborated accusations (“he said-she said” scenarios) in criminal cases. Additionally, each lawyer will conduct a short (5- to 10-minute) voir dire highlighting a technique that has proven successful in past trials.
